Mutual Recognition of Financial Penalties refers to the framework decision is to allow financial penalties imposed in criminal proceedings to be transferred between member states for enforcement, thereby improving enforcing enforceability of fines across the EU.
The EU Council Framework Decision 2005/214/JHA of 24 February 2005 on the application of the principle of mutual recognition to financial penalties will be incorporated into Scottish Law by way of a statutory instrument made under section 56 of the Criminal Proceedings etc. (Reform) (Scotland) Act 2007.
